Terms and Conditions

1. Agreement Scope

This rental agreement ("Agreement") is entered into between MIA Auto Rental ("Lessor", "Company", "We", "Us") and the customer ("Lessee", "Renter", "You"). By signing this agreement or using our services, you agree to be bound by these terms and conditions.

2. Florida Law Compliance

This rental agreement is subject to Florida Statutes, specifically:

• Florida Statute 324.021(7): The valid and collectible liability insurance and personal injury protection insurance of any authorized rental or leasing driver is primary for the limits of liability and personal injury protection coverage required by law.
• Florida Statute 627.736: Personal injury protection insurance requirements and benefits.
• All rentals must comply with Florida Vehicle Rental and Leasing regulations.

3. Vehicle Inspection and Condition

• The vehicle condition is inspected and agreed upon at the time of rental commencement.
• The Renter agrees that the vehicle is in good working condition at pickup.
• The Renter must return the vehicle in the same condition as received.
• Any damage, loss, or theft will be the Renter's responsibility.

4. Rental Duration and Renewal

• The rental duration is as specified in the rental agreement.
• Contract renewal requires written notification to the Lessor.
• Vehicles must be brought in for inspection at our office (3450 NW 36TH ST, Miami, FL 33142) for renewal.
• At least 1 day advance notice is required before vehicle return.
• Failure to provide notice may result in forfeiture of security deposit.

5. Payment Terms

• Rental fees are payable weekly in advance in US Dollars.
• Payment is due on the specified day each week.
• Accepted payment methods include Zelle (786-201-9949), credit card, cash, or bank transfer.
• A security deposit is required and will be held for the duration of the rental.
• Late Fee: $15.00 per day for late payments.
• Overdue accounts may result in insurance cancellation and additional penalties.

6. Geographic Restrictions

• The vehicle must be driven ONLY in Miami-Dade, Broward, and Palm Beach Counties, Florida.
• Use outside these areas is strictly prohibited and may result in additional charges.
• We are not responsible for mechanical issues outside the permitted area.
• Violation may result in contract termination and deposit forfeiture.

7. Vehicle Use and Restrictions

• Vehicle is for personal use only.
• NO SMOKING in the vehicle - violation will result in loss of deposit.
• Zero tolerance for illegal substances.
• Vehicle must be kept clean and in good condition.
• Only authorized drivers listed in the contract may operate the vehicle.

8. Maintenance and Repairs

• Basic maintenance (oil changes, brakes) is paid by the Lessor under prior appointment.
• Tire damage due to misuse or abuse is the Renter's responsibility.
• Renter must report any mechanical issues immediately.
• Maintenance must be performed at authorized facilities with prior approval.

9. Insurance Coverage

• Insurance is provided only for authorized drivers listed in the contract.
• CDW (Collision Damage Waiver), PAI (Personal Accident Insurance), and LDW (Loss Damage Waiver) options are available.
• Deductible: $2,000 in case of accident if insurance is declined.
• Insurance Cancellation: Insurance is automatically cancelled if rental payment is overdue.
• Accidents must be reported within 5 days or insurance coverage will be void.
• Unauthorized drivers are NOT covered by insurance.

10. Authorized Drivers

• Only drivers listed in the rental agreement are authorized to operate the vehicle.
• Additional drivers require 3 months written notice and approval.
• Minimum age: 25 years old.
• Valid driver's license required.
• Unauthorized use voids all insurance coverage and the Renter assumes full liability.

11. Vehicle Return Requirements

• Vehicle must be returned with a FULL TANK of gas.
• Return during business hours (Monday-Friday 10:30 AM - 6:00 PM, Saturday 11:00 AM - 5:00 PM).
• Late return: $20.00 per hour after scheduled return time.
• Fuel not full: $75.00 refueling fee.
• Dirty vehicle: $30.00 cleaning fee.
• Vehicle must be returned to: 3450 NW 36TH ST, Miami, FL 33142.

12. Traffic Violations and Tolls

• Renter is responsible for all traffic tickets, tolls, and parking fees.
• Unpaid fines will be deducted from security deposit.
• Administrative fee may apply for processing violations.
• Company reserves the right to report unpaid violations to authorities.

13. Security Deposit

• Security deposit amount is specified in the rental agreement.
• Deposit covers potential damages, fines, late fees, and cleaning.
• Deposit is refunded within reasonable time after vehicle return and inspection.
• Deposit may be forfeited for contract violations.

14. Accidents and Emergencies

• In case of accident, call 911 immediately.
• Report accidents to MIA Auto Rental within 24 hours.
• Obtain police report and other driver's information.
• Do not admit fault or liability.
• Failure to report within 5 days voids insurance coverage.

15. Contract Termination

The Company reserves the right to terminate this agreement immediately if:

• Renter fails to make timely payments
• Vehicle is damaged or mistreated
• Terms of contract are violated
• Vehicle is used outside permitted geographic area
• Unauthorized drivers operate the vehicle
• Illegal activities are conducted

Upon termination, the Company may recover the vehicle by any lawful means without refunding the deposit.

16. Collections and Legal Action

• Unpaid amounts may be sent to collections.
• Renter is responsible for all collection costs and legal fees.
• Company may file affidavit and pursue civil action.
• Disputes are subject to Miami-Dade County jurisdiction.

17. Renter's Responsibilities

• Comply with all traffic laws and regulations
• Maintain the vehicle in good condition
• Keep the vehicle locked and secure
• Report any issues or concerns immediately
• Return vehicle on time and in proper condition
• Provide accurate and complete information

18. Limitation of Liability

The Company is not liable for:

• Loss of personal belongings left in vehicle
• Consequential damages from vehicle breakdown
• Injury or death to third parties (covered by insurance only if terms are met)
• Issues arising from unauthorized use
• Mechanical failures outside permitted geographic area

19. Force Majeure

Neither party shall be liable for failure to perform obligations due to circumstances beyond reasonable control, including natural disasters, acts of God, war, civil unrest, or government action.

20. Entire Agreement

This Agreement constitutes the entire agreement between the parties and supersedes all prior understandings. Any modifications must be in writing and signed by both parties.
